    <span style="font-size:19px;line-height:150%;font-family: 黑体">第一章 总 则</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第一条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">为规范分布式光伏发电项目备案管理，按照“谁投资、谁决策、谁收益、谁承担风险”的原则，落实企业投资自主权，根据《国务院关于促进光伏产业健康发展的若干意见》及国家能源局《分布式光伏发电项目管理暂行办法》，结合我省实际，制定本办法。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第二条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">分布式光伏发电是指在用户所在场地或附近建设运行</span> <span style="font-size:16px;line-height:150%;font-family:宋体">以用户侧自发自用为主、多余电量上网，且在配电网系统平衡调节为特征的光伏发电设施。我省分布式光伏发电项目依据简化程序、提高效率的原则，由县级能源主管部门备案。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第三条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">省级能源主管部门负责全省分布式光伏发电全面组织协调工作；各州市能源主管部门负责本地区纳入国家指导规模的光伏发电项目备案工作。每年</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">12</span><span style="font-size:16px;line-height:150%;font-family:宋体">月</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">20</span><span style="font-size:16px;line-height:150%;font-family:宋体">日前向省级能源主管部门上报当地下一年度分布式光伏发电实施方案，总结当地本年度分布式光伏发电发展情况，提出下一年度需要国家资金补贴的项目规模申请。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">在国务院能源主管部门下达我省年度指导规模后，省级能贴资金的项目直接备案；需要国家补贴资金的项目在年度指导规模指标下达后方可备案。</span>
</p>
<p style="margin-top:10px;margin-right:0;margin-bottom:10px;margin-left:0;text-align:center;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">第二章 备案申请</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第五条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">鼓励各类电力用户、投资企业、专业化合同能源服务公司作为项目单位，投资建设和经营分布式光伏发电项目。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">项目单位在向备案机关申请备案时，应提交如下申办材料：</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（一）云南省分布式光伏发电项目备案申请表；</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（二）项目单位营业执照或者法人证书复印件。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">对个人不愧自有住宅及在住宅区域内建设的分布式光伏发电项目，由县级电网企业直接登记并于每个季度末集中向县级能源主管部门登记备案。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第六条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">企业要对项目申报材料内容的真实性负责。</span>
</p>
<p style="margin-top:10px;margin-right:0;margin-bottom:10px;margin-left:0;text-align:center;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">第三章 备案办理</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第七条办理程序如下：</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（一）受理标准</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">1</span><span style="font-size:16px;line-height:150%;font-family:宋体">、符合本办法第三条规定的项目；</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2</span><span style="font-size:16px;line-height:150%;font-family:宋体">、企业提交的申办材料齐全、规范、有效。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（二）备案机关职责</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">1</span><span style="font-size:16px;line-height:150%;font-family:宋体">、按照受理标准查验申办材料；申办材料符合标准的，给予办理备案手续，发放《云南省分布式光伏发电项目备案证》（以下简称“备案证”，该证有效期二年，逾期自动失效），加盖备案机关公章。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">申办材料不齐或有误的，将需要补正材料的全部内容和要求一次书面告知企业。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">申办材料不符合标准的，不予备案，出具的书面通知中要明确列出法规、政策依据。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2</span><span style="font-size:16px;line-height:150%;font-family:宋体">、及时告知申办企业务案结果；</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">3</span><span style="font-size:16px;line-height:150%;font-family:宋体">、制发的文书完整、正确、有效；</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">4</span><span style="font-size:16px;line-height:150%;font-family:宋体">、留存归档的备案项目文书与材料齐全。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第八条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">备案机关对云南省分布式光伏发电项目备案实行限时办结制度，在</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">10</span><span style="font-size:16px;line-height:150%;font-family:宋体">个工作日内完成备案工作。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第九条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">在年度指导规模指标范围内的分布式光伏发电项目，自备案之日起两年内未建成投产的，在年度指导规模中取消，并同时取消享受国家资金补贴的资格。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第十条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">已经备案的项目，如对建设地点、主要建设规模和建设内容以及投资主体等情况发生重大变化，企业应携变更情况说明和原备案证等，及时向原备案机关重新申请备案。</span>
</p>

    <span style="font-size:19px;line-height:150%;font-family: 黑体">第四章 其 他</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第十一条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">分布式光伏发电项目备案工作应当简化程序，免除发电业务许可、规划选址、上地预审、水土保持、环境影响评价、节能评估及社会风险评估等支持性文件。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第十二条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">云南电网公司负责建设云南省电网覆盖范围内分布式光伏发电的运行监测体系，配合省能源主管部门向所在地的能源管理部门按季报送项目建设运行信息，并定期将分布式光伏发电项目装机、上网电量及补贴资金等情况向社会予以公示；备案机关在做好备案工作的同时，要对光伏发电项目的备案材料进行整理、归纳和分析，并与每季度末向省能源主管部门报送相关材料（附件</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2</span><span style="font-size:16px;line-height:150%;font-family:宋体">和附件</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">3</span><span style="font-size:16px;line-height:150%;font-family:宋体">）。</span>
</p>
<p style="margin-top:10px;margin-right:0;margin-bottom:10px;margin-left:0;text-align:center;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 黑体">第五章 法律责任</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&nbsp;</span><span style="font-size:16px;line-height:150%;font-family:宋体">第十三条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">备案机关及其工作人员在办理项目备案过程中，应严格执行国家法律法规和本办法的有关规定，不得拖延备案时限。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第十四条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">备案机关工作人员，在项目备案过程中玩忽职守、滥用职权、佝私舞弊、索贿受贿的</span> <span style="font-size:16px;line-height:150%;font-family:宋体">依法给予行政处分；构成犯罪的，依法追究刑事责任。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第十五条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">企业在备案申报和建设过程中弄虚作假的</span> <span style="font-size:16px;line-height:150%;font-family:宋体">备案机关依法撤销备案或者报请上级部门撤销各案、情节严重的，依法追究责任。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第十六条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">各级政府能源主管部门，要设置投诉渠道和公布投诉电话，受理关于建设项目备案工作的投诉，欢迎社会各界参与监督。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第六章</span> <span style="font-size:16px;line-height:150%;font-family:宋体">附</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">&nbsp; </span><span style="font-size:16px;line-height:150%;font-family:宋体">则</span>

<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第十七条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">本办法由省发展和改革委员会负责解释。</span>
</p>
<p style="text-indent:32px;line-height:150%">
