<p style="text-indent:37px;line-height:150%">
    <span style="font-size:19px;line-height:150%;font-family: 宋体">第一条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">为加强森林资源保护管理，合理利用和节约使用森林资源，维护林权权利人的合法权益，根据《中华人民共和国森林法》、《中华人民共和国土地管理法》和《中华人民共和国森林法实施条例》等有关规定，现制定本标准。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第二条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">本标准所称建设项目使用林地，是指在林地上建造永久性、临时性的建筑物、构筑物，以及其他改变林地用途的建设行为。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（一）进行勘查、开采矿藏和各项建设工程占用林地。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（二）建设项目临时占用林地。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（三）森林经营单位在所经营的林地范围内修筑直接为林业生产服务的工程设施占用林地。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第三条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">凡在内蒙古自治区行政区域内进行勘查、开采矿藏和公路、铁路、机场、港口码头、水利、电力、通迅、能源基地、国家电网、油气管网等基础设施项目，科技、教育、文化、卫生计生、体育、环境和资源保护、防灾减灾、文物保护、市政公用、乡村公路、廉租房、棚户区改造等公共事业和民生项目，商业、服务业、工矿业、仓储、城镇住宅、旅游开发、养殖、经营性墓地等经营性项目，战略性新兴产业项目等永久性使用林地；</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">各类工程施工临时用地、工程建设配套的取（弃）土场用地、工程勘查、地质勘查用地及其他确需临时占用林地的，用地单位或个人应依法向被使用林地的单位或个人支付林地补偿费、林木补偿费和安置补助费。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">森林经营单位在所经营的林地范围内，修筑直接为林业生产服务的工程设施需使用林地的，不支付林地补偿费、林木补偿费和安置补助费。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第四条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">用地单位使用林地应支付的林地补偿费和安置补助费，依照自治区人民政府公布的最新《征地统一年产值标准和征地区片综合地价》规定林地补偿费和安置补助费标准，支付给被使用林地的单位或个人。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">用地单位办理使用林地审核审批手续需缴纳的森林植被恢复费，按照国家有关部门公布的最新森林植被恢复费征收和管理使用规定的标准，由林业部门负责预收。属于国务院林业主管部门或自治区林业主管部门审核审批的，由自治区林业主管部门负责预收森林植被恢复费；属于盟市林业主管部门审批的，由盟市林业主管部门负责预收；属于旗县（市、区）林业主管部门审批的，由旗县（市、区）林业主管部门负责预收。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第五条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">林木补偿费按下列标准补偿：</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">有林地、疏林地和灌木林地，应依据《中华人民共和国森林法》相关规定划分林种，按林种计算林木补偿费。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">补偿基数：一般乔木树种按每亩</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">6</span><span style="font-size:16px;line-height:150%;font-family:宋体">立方米出材量价值补偿；珍贵乔木树种按每亩</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">6</span><span style="font-size:16px;line-height:150%;font-family:宋体">立方米出材量价值的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">3</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">乔木树种出材量价值，是指当地同一树种或同类树种的木材按当地市场价格销售所得的收入。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">珍贵树种是指列入《国家重点保护野生植物名录》中的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">I</span><span style="font-size:16px;line-height:150%;font-family:宋体">、</span><span style="font-size:16px;line-height:150%;font-family:宋体">Ⅱ</span><span style="font-size:16px;line-height:150%;font-family:宋体">级保护乔、灌木树种。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（一）乔木用材林林木和乔木薪炭林林木：为补偿基数的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（二）乔木防护林林木：一般防护林林木为补偿基数的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">4</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿，国家级公益林林木按补偿基数的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">5</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（三）乔木特种用途林林木：为补偿基数的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">10</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（四）乔木经济林林木和灌木经济林林木：按单位面积当地同类经济林盛产期正常年均产值的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">6</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（五）乔木疏林林木：按同一林种乔木林林木的补偿标准补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（六）灌木林林木（除灌木经济林林木之外）：按同一林种乔木林林木补偿标准的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">0.5</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。其中灌木国家级公益林林木按乔木国家级公益林林木补偿标准的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">0.5</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（七）未成林造林地林木：乔木未成林造林地林木按补偿基数补偿，灌木未成林造林地林木按补偿基数的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">0.5</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（八）火灾烧死木：按火灾发生之前划定林种的林木补偿标准补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（九）有害生物为害木：按有害生物为害发生之前划定林种的林木补偿标准补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（十）零星林木：一般树种依据测得树木的材积，按当地同树种同径级原木每立方米销售价格</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍的补偿标准予以补偿。珍贵树种林木按一般树种林木补偿标准的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">2</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍予以补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（十一）苗圃苗木：按当地同种类苗木出圃时市场价的</span><span style="font-size:16px;line-height:150%;font-family:&#39;Times New Roman&#39;,&#39;serif&#39;">3</span><span style="font-size:16px;line-height:150%;font-family:宋体">倍补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">（十二）临时使用林地需采伐或移除林木的，按长期使用林地上的相同林种林木补偿标准予以补偿。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">被使用林地的地区某树种无法测算其成熟林林木出材量价值的，可参照邻近地区该树种的林木出材量价值测算补偿费用。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">被使用林地的地区某树种无成熟林出材量供参照的，可参照生物学特征相近似的树种测算补偿费。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第六条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">经旗县级人民政府依法审核同意，农牧民按规定标准建设宅基地使用本集体经济组织林地，需采伐或移除本集体经济组织所有的林木，不需支付林木补偿费。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第七条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">因长期使用林地或者临时使用林地，需采伐或移除的林木和苗木归原林权权利人所有。</span>
</p>
<p style="text-indent:32px;line-height:150%">
    <span style="font-size:16px;line-height:150%;font-family: 宋体">第八条</span> <span style="font-size:16px;line-height:150%;font-family:宋体">林木补偿费和苗木补偿费归被使用林地单位或个人所有，由用地单位支付给被长期使用或者被临时使用林地的林权权利人。任何单位和个人不得截留、挤占、挪用。</span>
</p>
<p style="text-indent:32px;line-height:150%">
