    <span style="font-size: 16px">为促进我市新能源项目健康发展，加快我市光伏发电项目建设，创新土地管理模式，根据《中华人民共和国物权法》、《土地登记办法》及《合肥市加强土地管理进一步做好节约集约用地工作意见》等有关法律法规，结合我市实际，制订本意见。</span>
</p>

    <span style="font-family: 黑体, SimHei; font-size: 18px;">一、适用范围</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px">本意见适用于市域范围内（含四县一市）光伏发电项目建（构）筑物用地及电池组列件用地。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-family: 黑体, SimHei; font-size: 18px;">二、适用原则</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">1.</span><span style="font-size: 16px">光伏发电项目用地应坚持政府引导、市场配置、合理布局、群众自愿、农电双赢的原则。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">2.</span><span style="font-size: 16px">光伏发电项目用地应优先使用荒山、荒滩、荒水等难以利用以及不适宜建设农业、生态、工业项目的土地，不占或少占耕地，最大限度降低对地面植被生长和生态环境的影响。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">3.</span><span style="font-size: 16px">光伏发电项目占用土地需转为建设用地的，应按照节约集约用地的原则，根据发电量控制用地规模，提高用地效率。</span>
</p>

    <span style="font-family: 黑体, SimHei; font-size: 18px;">三、用地方式</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">1.</span><span style="font-size: 16px">光伏发电项目办公综合楼等建筑物（构筑物）需永久性占用集体土地的，应在用地指标配置上予以优先安排。在项目用地征收转用为国有建设用地后，按照工业用途以招拍挂方式供应。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">2.</span><span style="font-size: 16px">光伏发电项目电池组件列阵架设若不破坏地表状况，且不影响地面原使用功能（包括种植、养殖功能）的，可采取地役权方式用地。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px">（</span><span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">1</span><span style="font-size: 16px">）光伏发电项目电池组件列阵架设在国有土地上的（包括建设用地、农用地、水面、荒山、滩涂等），由项目公司与土地使用权人签订《地役权使用合同》，以地役权方式用地。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px">其中架设在国有出让土地上的，地役权使用年限不得超过土地出让年限的剩余年限。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px">（</span><span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">2</span><span style="font-size: 16px">）光伏发电项目电池组件列阵架设在集体土地上的（包括建设用地、农用地、水面、荒山、滩涂等），经集体建设用地使用权人或土地承包经营户同意，由项目公司与集体建设用地使用权人或集体土地所有权人（村委会、居委会）签订《地役权使用合同》，以地役权方式用地。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px">其中架设在耕地上的，地役权使用年限不得超过土地承包经营年限的剩余年限，其架设高度宜</span><span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">2.5</span><span style="font-size: 16px">米以上，行间距宜</span><span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">3</span><span style="font-size: 16px">米以上，列间距宜</span><span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">2</span><span style="font-size: 16px">米以上，线路布置与桩基不得破坏耕作层，不影响农作物生长。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px">（</span><span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">3</span><span style="font-size: 16px">）光伏发电项目电池组件列阵架设在无主地上的，由项目公司与土地所在地乡（镇）政府签订《地役权使用合同》，以地役权方式用地。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-family: 黑体, SimHei; font-size: 18px;">四、其他规定</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">1.</span><span style="font-size: 16px">《地役权使用合同》的当事人应在合同中明确地役权土地权属、面积、价款、用途、年限等相关内容。</span>
</p>
<p style="margin-bottom: 0px; text-indent: 32px; line-height: 1.5em; background: white;">
    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">2.</span><span style="font-size: 16px">地役权自《地役权使用合同》生效时设立。当事人要求登记的，可以向县级以上国土资源管理部门申请地役权登记；未经登记，不得对抗善意第三人。</span>
</p>

    <span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">3.</span><span style="font-size: 16px">本意见有效期</span><span style="font-size: 16px;font-family: &#39;Times New Roman&#39;, serif">2</span><span style="font-size: 16px">年，自发布之日起施行。</span>
